Terms & Conditions
- 1. The company is not common and reserves their right to refuse or reject any bookings of goods without assigning any reason whatsoever.
- 2. This contract is not subject to Carriage By Road Act of 2007 and all the terms and conditions herein will be binding to the consignor/consignee.
- 3. All consignment are carried entirely at owner’s risk. Consignors should take out their own insurance to protect themselves against any or all risks at their description and on their own account.
- 4. The Company is not responsible for internal damages to the contents of packages of damages to unpacked goods or damages to perishable articles by deterioration or damages to brittle articles.
- 5. The Company is not responsible for the contents of packages if the packages are delivered in the same apparent condition in which they are tender for despatch by the consignor.
- 6. No guarantee for weight or contents can be given. As far as possible all precautions will be taken against pilferage.
- 7. The Company is not responsible for loss or damage to goods by leakage, breakage, evaporation and weather conditions, strikes, lock-outs, road and rivers hazards or defaults of staff, drivers, labourers or agents of the company not civil or political disturbances, explosion, fire or accident to vehicle by which goods are transported or fire to godown where goods are stored.
- 8. Delivery to consignee will be effected as quickly as possible but the Company will not be responsible for delays, damage or losses occurred through conditions beyond its control such as road and weather condition, strike, lock-out, civil or political disturbances, explosion, fire, breakdown or accident to vehicle by which goods are transported.
- 9. The Company will be at liberty to tranship goods from one vehicle to another at the company’s option and without incurring any liability or risks or damages arising out of such transhipment.
- 10. Timings for arrivals and departures are not guaranteed and are subject to change without notice at any time. If the Consignor intends to get its Consignments transported within a particular period of time then the same shall be mentioned to the Carrier and which is to be incorporated in the GC Note. The Company would also not be responsible for the losses arising because of delay in delivery for any reasons. Goods would be transported to the destination at the earliest possible.
- 11. Freight and other charges if not prepaid are payable at the time of delivery. The Company has the right to hold the material against any past and present dues from the Consignor / Consignee.
- 12. The Consignee copy of the GC Note should be surrendered by the consignee or his duly authorised representative at the time of delivery of consignment at destination.
- 13. The GC Note marked for : Door delivery (Direct) are not meant for bank. Goods will not be delivered without Consignee Copy.
- 14. If the Consignee does not himself take delivery he must endorse on the Received the consignment as per particulars overleaf from BHAVNA ROADWAYS properly packed in Dry, Sound and Good condition G.C. Note and request for delivery to be guaranteed to the persons to whom he wishes it made.
- 15. Consignment marked for delivery to “SELF” should be collected by the Consignee at his own cost from our Branch/Depot at destination. If desired, delivery can be effected at Consignee’s place on payment of extra charges and on surrendering the Consignee copy of GC Note.
- 16. The Company has the right of re-measurement, re-weightment, re-classification of goods before they are delivered and of collecting any amount that may have been omitted or under-charged.
- 17. The consignor making false declaration as to the contents, description, quantities of goods carried will be held liable for any damage, which the carrier may sustain as a result of such false declaration. Consignor will therefore declare his goods correctly and take every precaution to comply with the Customs of Government Regulations in force from time to time. Carrier will not be responsible if any goods are declared to be contraband and confiscated by any government. Consignor is liable for all consequences arising out of incorrect declaration of the contents of the consignment.
- 18. The Consignor is responsible to obtain and hand over to the Company at the time of booking the goods appropriate permits for transport by roads in case of restricted articles in case of failure. Consignor will be held responsible for consequences arising out of such transport without permit.
- 19. The delivery of the goods must be taken or rebooked within 7 days of its arrival destination failing which storage rent at the rates shown below will be charged for the period upto the date of collection by the consignee or consignor. • Rs. 15.00 per day per article
- 20. The Company is not responsible in the events of the goods being detained or seized or confiscated by appropriate Government authorities.
- 21. On consignment weighing less than 50kgs, charge will be Subject to a minimum.
- 22. The Transport Contractors shall have the right to remove to their Unclaimed Property Depot and sell and dispose of by public auction or by private contract, perishables lying undelivered after 3 days of arrival without notice and other goods after 30 days of arrival without any notice to consignor or consignee. The Transport Contractors shall appropriate, adjust or deduct their dues including freight, octroi, wharfage, handling and other incidental expenses and account for the surplus to or recover the deficit from the consignor or consignee or both.
- 23. The Company carries the goods on the basis “SAID TO CONTAIN”. The Consignor shall indicate the inherent dangers, perils, hazard pertaining to the Consignment (such as inflammability, reactions, dangers to life & property etc.) during transportation and handling and if any such incident occurs, the Consignor is fully liable for all consequences arising out of incorrect declaration of the contents of the goods. The Company will have the liberty to detain such Consignments, if there is reasonable suspicion of such wrong declaration. The Consignor shall be responsible to compensate the Company for any damages or losses caused by such wrong declaration.
- 24. The branch staffs are not authorized to give any Certificate of Loss. The same can be Issued only be the Regional Manager. Certificate of Fact (COF) can be issued only by the Regional Manager on valid pre-printed stationery after due verification of loss and receipt of specified documents. Any such certificate given by the branch staffs on this Goods Consignment Note or Letterhead are not legally valid.
- 25. If any Damage/leakage/breakage/loss, matter has to be informed same day of delivery.
- 26. In case of damage, breakage, leakage or loss of consignment, the claim amount cannot exceed 3 times the freight value of the material transported.
- 27. In case of Insurance taken from us for the material transported, minimum deduction will be 10% of total claim amount.
- 28. Insurance of material at your end. In case of any miss happening the consignment Enrooted, our liability will be limited to providing you the Certificate of Fact (COF) only. Freight bills cannot be withheld due to unexpected accidents.
